Terms & Conditions for Aerialist Services
1. General Terms
1.1 The Aerialist ("Performer") agrees to provide entertainment services as outlined in the booking agreement with the Client ("Client").
1.2 These T&Cs are applicable to all bookings, unless otherwise agreed in writing between the Performer and the Client.
2. Payment
2.1 A deposit of 10% is required to secure the booking, payable within 5 working days (Mon-Fri) of the booking confirmation.
The remaining balance must be paid no later than 10 working days (Mon-Fri) after receiving invoice.
2.2 Payments can be made via bank transfer or PayPal
2.3 In the event of cancellation by the CLIENT, the following applies:
. If cancellation is made 30 days or more before the event, 25% of the full fee is still due (inclusive of deposit)
. If cancellation is made 7 days or more before event, 50% of the full fee is due (inclusive of deposit)
. If cancellation is made 48 hours or more before event, 75% of the full fee is due (inclusive of deposit)
. If cancellation is made 24 hours or less before event, the full fee is due.
3. Equipment and Rigging Safety
3.1 The Client must ensure that the venue meets all safety requirements for the installation of aerial rigging, including but not limited to ceiling height, load-bearing capacity, and anchor points.
3.2 Proof that a safety check has been made on the rigging and equipment by a qualified professional within the last 3 months is required in advance of the performance, and equipment, rigging and venue must meet LOLER standards.
3.3 The Performer will inspect and approve the rigging setup prior to performance. If the rigging setup is deemed unsafe, the Performer reserves the right to cancel the performance for safety reasons, with no obligation for a refund.
3.4The Client is responsible for any damage to the Performer's equipment caused by venue staff or guests.
4. Liability and Insurance
4.1 The Performer carries public liability insurance for all performances.
4.2 The Client must provide a safe environment and comply with all local safety regulations.
4.3 The Performer is not liable for any injuries or damages caused by the Client’s negligence or failure to comply with these T&Cs.
5. Performance Requirements
5.1 The Client must provide adequate space for the performance, including a clear area around the aerial rigging.
5.2 The Client must ensure suitable lighting, sound, and other technical requirements as outlined by the Performer.
5.3 The Performer requires a secure and private changing area.
6. Force Majeure
6.1 Neither party shall be liable for any failure to perform its obligations under this agreement if such failure is due to circumstances beyond reasonable control, including but not limited to acts of God, war, terrorism, or government regulations.
7. Intellectual Property
7.1 The Performer retains all rights to their performance, including choreography and costuming.
7.2 The Client may not record or distribute the performance without prior written consent from the Performer.
8. Governing Law
8.1 These T&Cs are governed by the laws of the United Kingdom.
8.2 Any disputes arising from these T&Cs shall be resolved through mediation or, if necessary, in the courts of the United Kingdom.
9. Miscellaneous
9.1 Any amendments to these T&Cs must be made in writing and signed by both parties.
9.2 The invalidity or unenforceability of any provision of these T&Cs shall not affect the validity or enforceability of any other provision.
